These Terms of Service ("Terms") govern your use of our website and the general terms under which Bad 2 Better Construction LLC (“we,” “us,” or “our”), a Wisconsin limited liability company based in Spooner, provides construction and renovation services.
By accessing our website or engaging our services, you agree to be bound by these Terms.
1. Scope of Services
Bad 2 Better Construction LLC provides residential and commercial construction, remodeling, and renovation services. Detailed scopes of work, project timelines, and specific deliverables for any project will be outlined in a separate, signed Construction Contract Agreement.
2. Estimates and Proposals
- Any estimates provided via the website or over the phone are preliminary and non-binding.
- A formal, binding agreement is only established once a written contract is signed by both parties.
- Quotes are valid for 30 days from the date of issuance due to fluctuating material costs.
3. Payment Terms
- Deposits: A mobilization deposit is typically required before work commences.
- Milestones: Progress payments may be scheduled based on project phases (e.g., framing completion, rough-in, etc.).
- Final Payment: The remaining balance is due immediately upon substantial completion of the project.
- Late Fees: Payments not received within 15 days of the invoice date may be subject to a late fee of 1.5% per month or the maximum rate permitted by Wisconsin law.
4. Wisconsin "Right to Cure" Law
Pursuant to Wisconsin Statute § 895.07, Wisconsin law contains important requirements you must follow before you may file a lawsuit for defective construction against a contractor.
- You must deliver a written notice of any construction conditions you allege are defective to Bad 2 Better Construction LLC at least 90 working days before commencing legal action.
- We then have the opportunity to inspect the alleged defect and provide an offer to repair or settle the claim.
5. Change Orders
Any deviations from the original signed contract (changes in materials, scope, or design) must be documented in a written Change Order and signed by both the client and Bad 2 Better Construction LLC. Additional costs and time extensions will be applied accordingly.
6. Client Responsibilities
- Access: The client must provide timely access to the property for workers and equipment.
- Permits: Unless otherwise stated in the project contract, the client is responsible for identifying any local homeowner association (HOA) restrictions. We will typically handle municipal building permits.
- Site Safety: Clients and unauthorized individuals must remain clear of the active work zone for safety and liability reasons.
7. Limitation of Liability & Indemnity
- Property Damage: While we take every precaution, we are not liable for pre-existing structural issues discovered during demolition or "acts of God" (weather, etc.).
- Website Use: Our website content is for general information. We are not liable for technical inaccuracies or typographical errors on the Site.
8. Governing Law
These Terms and any project contracts shall be governed by and construed in accordance with the laws of the State of Wisconsin. Any legal actions shall be brought in the courts of Washburn County, Wisconsin.
